書面による契約を・・
特商法にある「業務提供誘引販売取引」のひとつ。
内業務提供誘引販売取引とは、その名の通り「業務（仕事）を提供しますよ」と言って勧誘します。
〝内職商法・モニター商法・資格商法〟などがこれにあたります。
そして、この契約には契約書が必要です。
１つは、契約する前に契約の概要を書いた書面（概要書面）の交付です。
内容は、次の通りです。
①販売業者の氏名・名称、住所、ＴＥＬ（法人にあっては代表者氏名 ○ ○）
②商品の種類・性能・品質に関する事項（権利・サービスの種類及びこれらの内容に関する事項）
③商品名
④商品･サービスを利用する業務の提供（あっせん）についての条件に関する事項
⑤特定負担に関する事項
⑥契約の解除条件その他契約に関する重要な事項
⑦割賦販売法（３０条の４）に関する事項
そして、契約書類です
内容は、上記のほかに、次の項目が必要です。
⑧契約締結の担当者氏名
⑨契約年月日
⑩特定負担以外の義務についての定め
この中で⑥の内容がいわゆるクーリングオフに関する事項ですね。
電話だといわゆる「言った・言わない」もあります。
後で、これも確認するんだったと思っても後の祭り。
そうそう、この２つの書面、一緒の交付は法律違反です。
契約の際には、必ず書面で！！
そして、あづかった書類は、その内容がきちんと全て記載されているか確認してください。
書面を発行しなかったり、内容が不備な会社とは、早くさよならです。
